Duck Creek North, between James Cook Drive and Discovery Drive, Whitby (being Lot 101 DP 459040 and Lot 19 DP 454142) and 15, 21, 23, 25 and 29 Observatory Close, Whitby (being Lot 1431 DP 54453, Lot 1434 DP 54453, Lot 1435 DP 54453, Lot 1436 DP 54453 and Lot 1438 DP 54453).

Proposal:

The applicant is seeking resource consent from Greater Wellington Regional Council and Porirua City Council to undertake various activities associated with the subdivision and residential development within the Duck Creek catchment at Duck Creek North. The works include the permanent diversion of two sections of Duck Creek, bulk earthworks, reclamation of the diverted sections of Duck Creek, the discharge of sediment laden water, the installation of pipes, and permanent and temporary bridges, stream bank stabilisation, subdivision of approximately 13 hectares of land into 149 residential lots, lots to vest as road, reserves and access, and the construction and installation of roading, stormwater and other infrastructure services.

Consents applied for from Greater Wellington Regional Council:

 

  • Water permit [33621] – To divert the flow of Duck Creek in the following manner:
    • The permanent diversion of the full flow of two reaches of Duck Creek into newly constructed stream channels, being approximately 71 metres and 9 metres in length.
    • The temporary diversion of the full flow of Duck Creek associated with the installation of a stormwater pipe under the bed of Duck Creek.
  • Discharge permit [33622] – To discharge sediment and chemical flocculant in treated stormwater runoff to Duck Creek, and to land where it may enter Duck Creek, in association with bulk earthworks for a residential subdivision.
  • Land use consent [33623] – To:
    • construct three permanent bridges over the bed of Duck Creek, including any associated disturbance, discharge and deposition of material in the bed of that stream
    • place 11 stormwater inlet and outlet structures and associated erosion protection works in the bed of Duck Creek at various locations, including any associated disturbance, discharge and deposition of material in the bed of that stream
  • Land use consent [33624] - To reclaim the bed of Duck Creek in two reaches, being 185 metres and 25 metres in streambed length
  • Land use consent [33647] – To place a stormwater pipe under the bed of Duck Creek including any associated disturbance, discharge and deposition of material in the bed of that stream
  • Land use consent [33648] – To construct three temporary bridges over the bed of Duck Creek, including any associated disturbance, discharge and deposition of material in the bed of that stream
  • Land use consent [33649] – To undertake bank stabilisation works in Duck Creek, including any associated disturbance, discharge and deposition of material in the bed of that stream

Duration sought:

The applicant has sought a duration of 10 years for all consents (with the exception of maintenance period for structures within Duck Creek which will have a 35 year duration). Overall, the activity is classified as a Discretionary Activity under the Operative Regional Freshwater Plan for the Wellington Region.

Consents applied for from Porirua City Council:

Subdivision: To undertake a 149 residential lot subdivision in 4 stages, including 6 roads to vest, access lots, 4 reserves and 3 walkway reserves.

Land use:
  • Bulk earthworks consisting of 142,600m3 of cut and 143,440m3 of fill that disturb an area of approximately 10.5 ha and to a maximum fill height of 4.0 metres and cut depth of 5.5 metres. 101,500m3 of excavated material will be imported to the site. During the bulk earthworks construction phase between 80 and 110 daily vehicle movements are anticipated.
  • Maximum site coverage of 45% is proposed for residential lots which is greater than the 35% permitted activity standard.
  • Front yard setbacks are proposed to be reduced from 5 metres to 3 metres off legal road for dwellings (eaves of up to 600mm are proposed toextend into the 3m front yard). A 5m front yard setback is also proposed for any garage building and parking within the front yard setback.
  • Proposed Lot 6 & Lot 100 cannot comply with a contiguous outdoor living area with respect to gradient and permeable surface.
  • Roads 1, 2, & 3 are under width, with a proposed legal road width of between 12-19.4m and carriageway width of 7.0m (with intermittent parking) which is less than required 20.0m legal road width and 11.0m carriageway width needed to comply with Part H of the District Plan. Privatedriveways are proposed with a minimum legal width of 3.2m which is less than required 3.5m permitted standard.
  • The applicant seeks a waiver of esplanade reserves pursuant to s230(3) of Resource Management Act 1991.
  • The applicant seeks a waiver of Part E of the District Plan for financial contributions and intends to enter into a development agreement to satisfy reserve contributions.
Cancellation of Consent Notice:
  • Cancellation of Consent Notice 9231374.7 containing conditions relating to fencing, flooding and other land development limitations including soil limitations and liquefaction.

Duration sought:The applicant has sought a 10 year lapse period for both the subdivision and land use components of the consent.
